Services are provided as configured and agreed upon in writing.
3. Eligibility
Services are available to individuals aged 18 or older and to businesses operating lawfully.
4. Payment Terms
One-Time Builds
Payment is due upfront unless otherwise agreed.
Partial refunds may be issued at EleVare Systems’ discretion depending on the stage of project completion.
Hybrid / Ongoing Plans
Monthly fees auto-renew.
Minimum 72 hours’ written notice is required to cancel before the next billing cycle.
Failure to pay may result in suspension of services.
Payments are processed via Stripe.
5. Client Responsibilities
Clients agree to:
Provide accurate information
Maintain lawful marketing practices
Obtain proper consent from their leads
Comply with SMS and data protection laws
Review and approve automation systems prior to launch
Clients retain ownership of their customer data.
6. AI & Automation Disclaimer
EleVare Systems deploys automated and AI-powered systems.
Client acknowledges:
AI outputs may contain inaccuracies
Systems operate automatically once deployed
No guarantee of specific revenue, lead volume, or financial outcome is made
Clients are responsible for monitoring system performance.
7. Intellectual Property
EleVare Systems retains ownership of:
System frameworks
Automation structures
Templates
Internal methodologies
Clients retain ownership of:
Their customer data
Their brand materials
Content they provide
Custom configurations built for clients are licensed for use within their business.
8. Limitation of Liability
To the maximum extent permitted by law:
EleVare Systems’ total liability shall not exceed the total fees paid by the Client under the applicable agreement.
We are not liable for:
Indirect or consequential losses
Lost profits
Business interruption
AI inaccuracies
Third-party platform failures
9. Termination
We may suspend or terminate services for:
Non-payment
Misuse
Illegal activity
Breach of these Terms
Upon termination, client access to systems may be removed.
10. Governing Law
These Terms are governed by the laws of England and Wales.
Any disputes shall be subject to the courts of England and Wales.
11. Changes
We reserve the right to update these Terms at any time. Continued use of services constitutes acceptance of changes.
12. Indemnity
The Client agrees to indemnify, defend, and hold harmless EleVare Systems, its owner, affiliates, contractors, and service providers from and against any and all claims, liabilities, damages, losses, fines, penalties, costs, and expenses (including reasonable legal fees) arising out of or related to:
(a) the Client’s breach of these Terms;
(b) the Client’s failure to obtain lawful consent to process or market to any individual;
(c) any unlawful, misleading, or non-compliant marketing practices carried out using systems configured by EleVare Systems;
(d) any data provided by the Client that infringes third-party rights or violates applicable data protection or telecommunications laws;
(e) claims arising from the Client’s use of third-party platforms including but not limited to Stripe, HighLevel, and Twilio.
The Client acknowledges that EleVare Systems acts solely as a software implementation and automation provider and does not assume responsibility for the legality of the Client’s data collection, marketing practices, or regulatory compliance obligations.
